The Rules have not Changed Since AI 23/82

These Instructions were part of AI 23/82, which was compiled following agreement at national level with the then POEU. There have been no agreed changes and the principles still apply post NewGrid.

Bank Holidays

  • A bank or public holiday falls on a day normally scheduled for attendance but which can be taken as a day off:-

    a) The holiday is allowed irrespective of the number of scheduled hours of duty that would have been required had it not been a Bank or Public holiday. No entry is made on the Leave Record Card.

    b) If the Bank holiday falls within a period of normal Annual Leave, then the scheduled duty hours for that day are not debited from the total amount of leave taken.

eg Attendance scheduled for 4 days and an off day, and a Bank holiday occurs on a different day to the off day in the same week:

To obtain a week free from scheduled duty in the above circumstances, add up the total hours scheduled for the week and then deduct the hours scheduled for the Bank Holiday. The balance is the amount to be debited on annual leave cards to give a week free from scheduled duty.

  • A Bank holiday falls on a day scheduled as an off day and an attendance is not required.

A credit of the normal scheduled hours is allowed. This will be entered on the Leave Record Card as an addition to the balance of leave hours outstanding with a note in the Remarks Column, "Credit for off day on Bank Holiday". (This does not apply to Rota Staff).

  • A Bank holiday falls on a day normally scheduled for attendance and an attendance is made.

    or

  • A Bank holiday falls on a day normally scheduled as an 'off day' and an attendance is made.

In both these circumstances, 23/82 talks of various combinations of compensation and credited time off. These figures are likely to be out of date post Newgrid and reference should be made to Bank & Public holiday Compensation as covered in the Newgrid Documentation.

    Compensatory Leave.

Leave in lieu of Bank or Public holidays will be in hours and will be integrated with annual leave on the leave card. Compensatory Leave may be carried forward into the New Year in addition to the normal 5 days.

    Sick Leave.

When Sick/special leave is taken, the normal duty hours scheduled for the days covered by the period of leave will be credited (excluding any scheduled overtime).

A scheduled days absence occurring at the beginning or the end of a period of sick/special leave will not count as sick/special leave and no credit will be given. The absence will be considered as SDA (Scheduled Days Absence).

A scheduled days absence occurring within a period of sick/special leave will count as sick/special leave for the record purposes and no credit will be given.

    Sick Absence and SDA.

    Example 1.

    SDA Monday 26th January

Sick Absence 1 week from 26th January, recorded as 4 days SA 27 - 30 January.
    Monday 26th Remains SDA

    Example 2.

    SDA Friday 30th January

Sick Absence 1 week from 26th January recorded as 4 days SA 26 - 29 January
Friday 30th January remains SDA Example 3. SDA Friday 30th January Sick Absence from 26th January recorded as 12 days Sick Absence 26 January - 6th February Friday 30th January is recorded as sick absence and the SDA is lost.
